News | Decree No. 10,886 establishes the Brazilian National Intellectual Property Strategy (ENPI) for the period 2021-2030

On December 8, 2021, the Federal Government published Decree No. 10,886, establishing the Brazilian National Intellectual Property Strategy (ENPI) for the period 2021-2030.

According to Art. 1 of the Decree, the provided strategy defines “long-term measures for coordinated action by the agencies and entities of the direct federal, autarchic and foundational public administration, in order to establish an effective and balanced Brazilian National Intellectual Property System.”

The Art. 2 of the Decree prescribes some of the guidelines, including the use of Intellectual Property as a way to encourage innovation, new creations and knowledge; the use of Intellectual Property in public policies to promote competitiveness and economic, social and technological developments; and continuous search, by the public administration, for practical solutions in short, medium and long terms, in line with a strategic vision for the future.

The ENPI will be implemented through biennial action plans, which will contain priority actions, results, deadlines and goals, as per the provision of Art. 3 of the Decree. Moreover, Art. 4 of the Decree provides that the responsible for implementing, monitoring and articulating the actions of the ENPI will be the Brazilian Interministerial Group of Intellectual Property (GIPI).
