Starting July 30, 2020, companies that fit the legal definition of startup may request priority in the examination of their patent applications filed before the BPTO.

The purpose is to encourage the consolidation of technology companies in the market, since obtaining patent protection evidences the originality of the invention and facilitates its commercialization. Until the end of the first half of 2020, the average examination time for a patent application in the priority regime was 13 months.
