News | Law 14,195/21 revokes the need for prior approval from ANVISA for pharmaceutical patents in Brazil.

On August 26, 2021, the Federal Government sanctioned Law No. 14,195/21, whose main purpose is to amend and revoke procedural acts to reduce bureaucracy and to bring innovations to the business process, giving special attention to foreign trade.

Among others, the Law revoked Art. 229-C, of the Brazilian Industrial Property Law, meaning that, since August 26, 2021, the prior approval of ANVISA (Brazilian FDA) is no longer a requirement for the granting of pharmaceutical patents. This does not mean, however, that ANVISA cannot present subsidies for the exam of a patent application.
