The Superior Court of Justice of Brazil has rendered a decision which prevents the Central Officer for Collection and Distribution (“Escritório Central de Arrecadação e Distribuição” – ECAD) to perform generic charges on the broadcast of works without considering a range of situations covered by agreements for their exhibition.

The Fourth Panel of the Superior Court also held that the condition of legitimate body for collection and distribution of copyright shall not relieve the responsibility to demonstrate the correctness of values collected in a particular case.
