Recently, Artificial Intelligence (AI) has spread to all kinds of different areas. Today, it can be found in facial recognition on cell phones, virtual assistants, traffic apps, and many other applications.

AI is a technology that works by combining digital data and algorithms. As such, systems must be constantly provided with accurate data to learn by interpreting patterns.

There is a great difference in creations assisted by artificial intelligence, which require human intervention, and the ones generated by artificial intelligence, lacking minimal to none human contribution.

In art, AI is being used to produce music, images, and even movie scripts, among others.

However, the recent expansion of AI-generated images has raised further discussions about copyright protection of artworks produced by this technology, in addition to conversations about the authorization of the authors of the original works for the production of derivative arts created by AI.

In Brazil, as well as in many other parts of the world, there is still no specific legislation that provides for the protection of artworks generated by AI. Considering the growing evolution of content produced by AI, some alternatives for the protection of its rights are explored nationally and internationally.

There are those who defend the possibility of the AIs themselves being the authors of the works. Others argue that authorship should be granted to the person who makes the necessary arrangements for the creation of the artwork (programmers or companies that own the software copyright).

On the other hand, some people point out that the users, responsible for indicating the characteristics of the artwork, should have the authorship. While others defend the idea that artistic works produced by AI should be in the public domain.

The developments in AI and related discussions regarding privacy, information security, technological development and copyright will keep AI as a hot topic in 2023.
