News | Brazilian PTO (BRPTO) publishes Resolution 217/2018 regarding the fast-track examination of pharma-related patent applications and patents

The Industrial Property Gazette (RPI) 2470 published Resolution 217, which amended Resolution 80 of 2013. Therefore, since May 8, 2018, patent applications related to pharmaceutical products and processes (as well as equipment and materials used in these areas) related to Zika and Chikungunya have also become part of the list of patents related to neglected diseases that benefit from the fast track examination before Brazilian Patent and Trademark Office (BRPTO).

The new Resolution has also included applications for rare diseases, classified by the World Health Organization (WHO) and by Brazilian guidelines for treatments under the National Healthcare System (SUS), as diseases which affect up to 65 people per 100,000 subjects or 1,3 people per 2,000 subjects.

Additionally, an important point included in the new Resolution 217 was that also patents already granted could benefit from the fast track examination in the BRPTO’s Appeal instance.

It should be pointed out that this measure demonstrates the BRPTO’s alignment with the public health care policies of the Brazilian Ministry of Health and with the development of the industrial complex in the area of ??Health.
