Firm News | The BRPTO published Ordinance No. 405/2020, of December 29, 2020, which regulates the presentation of the Sequence Listing in electronic format in patent applications

On December 29, 2020, by means of Industrial Property Gazette No. 2608, the BRPTO published Ordinance No. 405/2020, which provides for the procedures for the presentation of the Sequence Listing in electronic format for the purpose of complementing the description of the specification contained in the patent applications filed before the BRPTO. This Ordinance will enter in force on January 4, 2021 and revokes Resolution No. 187/2017 of April 27, 2017.

This Ordinance updates the presentation of the Sequence Listing to the electronic format, by means of the Electronic Petitioning system, and no longer by CD or DVD. This update also provides for presentation in XML format, in addition to the previously accepted TXT format.

The Sequence Listing may additionally be presented in PDF format, as an integral part of the patent application, being placed after the specification.

The Ordinance maintains the determination that the representation of the sequences in the Sequence Listing must follow the WIPO Standard ST.25. However, as of the date of entry into force of this Ordinance until December 31, 2021, the applicant may, alternatively and voluntarily, follow the Standard ST.26, defined by WIPO.
